St. Charles teen accused in fatal DUI may be jailed

A St. Charles teen facing DUI and reckless homicide charges could find herself in jail soon if a judge agrees to revoke her bail.

Prosecutors filed a motion Friday accusing Erika N. Scoliere, 19, of violating the terms of her release by failing to make weekly phone calls to Kane County court services for nearly a year. They are asking Judge Allen Anderson to revoke the college student's bail.

Scoliere has been free on bond since she surrendered Sept. 17 on charges of reckless homicide and drunken driving stemming from a July 2007 crash in South Elgin that killed 40-year-old motorcyclist Frank Ferraro. She has pleaded not guilty.

Under the terms of her release, Scoliere was allowed to forego electronic home monitoring, and also to live in a dorm room at the University of Dayton, as long as she provided her new address to the court and checked in weekly by phone.

On Friday, Scoliere's attorney, Sarah Toney, didn't dispute that her client has failed to make the calls, but she said it's all a mix-up.

"We were all under the impression they (court services) were going to call her to set up the times she was going to report," said Toney, noting that Scoliere has attended all of her scheduled court appearances. "It was simply a whole lot of confusion. It wasn't willful on Erika's part whatsoever."

Earlier this month, the Scoliere case made headlines when it was revealed that South Elgin police couldn't find a key piece of evidence - a blood sample taken from Scoliere the night of the crash - being used to prosecute her. The defense has since asked Anderson to suppress the evidence, purported to show Scoliere was intoxicated.

Arguments for the motion to revoke bail are set for Thursday, with a three-day hearing on the motion to suppress evidence to follow on Dec. 4, 5 and 11.
