Briefs: Facio hearing set

A Kane County judge will hear arguments next month over whether hearsay should be allowed in the prosecution of an Elgin teen charged with raping an 8-year-old neighbor last August. In addition to the victim's testimony, the state wants to cite two statements from acquaintances of the victim, which show the allegations against Angel Facio, 16, are "consistent and she didn't make it up," Assistant State's Attorney Christine Bayer said Wednesday. The hearing is set for Sept. 18. In May, Facio was sentenced to five years in prison after pleading guilty to the attempted murder of an Elgin High School teacher he stabbed multiple times in the head. He also is accused in the Jan. 16 attempted abduction of a 13-year-old Larsen Middle School student.
