No charges in pedestrian's death in Campton Hills
No charges are expected in the death of a pedestrian who was struck and killed by a vehicle Saturday in Campton Hills, just hours after the victim was arrested on suspicion of driving drunk.
"It does not look like the driver was at fault," Campton Hills Police Chief Greg Anderson said today. "At this point, it does not look like any charges will be filed."
Witnesses told police they saw 33-year-old Marcel Lizak of Montgomery dart onto Route 38 about 11:18 p.m. Saturday, when he was struck by a Honda sport utility vehicle near LaFox Road. The impact caused Lizak to bounce off the vehicle's windshield and hit the ground, police said.
Lizak was flown to a Downers Grove hospital, where he was pronounced dead. Preliminary autopsy results this morning showed Lizak died of injuries sustained in the accident. The DuPage County Coroner's office said toxicology tests, expected to show Lizak's blood-alcohol level at the time of death, are pending.
According to police, Lizak was arrested and charged with driving under the influence of alcohol about five hours before he was killed. The arrest took place after a patrol officer spotted Lizak driving erratically on the village's far north end, near its border with Elgin, Anderson said.
Lizak, who refused a breath test, was released from police custody shortly before 8:30 p.m. after surrendering his driver's license and posting $100 bail. From there, it appears the Kane County man trekked on foot to a tavern across the street from the police station, where he continued drinking alcohol, Anderson said.
The chief added that local police had no prior contact with Lizak and "no idea" what he was doing in the area. Officers are unable to hold a suspect who has posted bail, Anderson said, and Lizak, whose vehicle had been towed earlier in the evening, apparently had no other form of transportation when he was released.
"He was probably fairly impaired," Anderson said. "And when you're impaired like that, I think his judgment was probably clouded."
Lizak appears to have no criminal in Kane County. In March, he was issued a $75 parking ticket in Oswego.
Anderson said the investigation is expected to be complete later this week, but he does not anticipate charges involving either the driver or the bar that served Lizak.
