3 charges in gun incident near school
An Elgin man is facing three felony charges in court this morning after police said his handgun was used during a gang-related fight near a school Tuesday.
Police responded to a call for a fight involving a person with a handgun behind Washington Elementary School, 819 W. Chicago St., about 3:45 p.m., Elgin police said.
Officers located the offenders in a vehicle near the school based on descriptions from witnesses and found ammunition in the vehicle, police said.
A 16-year-old male juvenile accused of striking a victim during the confrontation was charged with battery and released to his parent, police said.
During the investigation, police learned that the handgun used in the altercation was in the garage of Juan Luis Marquez-Nieto, 18, of 179 S. Commonwealth.
Police recovered the .22 revolver and ammunition from the home and charged Marquez-Nieto with three counts of aggravated unlawful use of a weapon, all class four felonies, police said.
Those charges stem from the possession of a handgun by a subject under the age of 21; without a valid FOID card and being an uncased firearm in a motor vehicle, police said.
