Is it really a conflict of interest?
What does one do with two judges elected to administer justice when they refuse to do so?
Both have refused to sign a court order to preserve the evidence collected in a DUI arrest of Circuit Judge David Hall, claiming a desire to "avoid any perception of conflict of interest."
The evidence speaks for itself and ordering its preservation cannot be interpreted as a conflict of interest. But the refusal by the two judges can be seen as an attempt to impede justice.
Should either of them preside over a trial where Hall is found to be guilty, fair punishment is that which any other citizen would be given under the circumstances. There is no conflict of interest, just a refusal to perform their duty.
