Elgin teen pleads not guilty in sex assault

An Elgin teenager pleaded not guilty Friday to charges he sexually assaulted an 8-year-old girl, offenses police say took place about five months before he was accused of stabbing an Elgin High School teacher.

Angel Facio, 16, was arraigned on charges related to the August 2007 rape. The Kane County charges were filed after the 16-year-old was jailed in connection with the Jan. 18 stabbing at the school.

Also Friday, Facio was ordered to surrender a sample of his DNA for comparison to evidence collected in the sex assault, prosecutor Christine Bayer said.

Test results aren't expected for four months because of the heavy caseload at the crime lab, she said.

Defense attorney Nils Von Kuedell said he could seek to have an outside DNA expert on hand when the sample is tested.

Facio is in a Chicago juvenile detention facility pending an April 30 hearing that could determine if he is tried as an adult in Cook County in the attack on teacher Carolyn Gilbert. Gilbert lost her right eye after the attack.

Gilbert was alone with Facio in a classroom when a coat was thrown over her head and she was stabbed several times with a kitchen knife, police have said.

Facio also is accused of, two days before the stabbing at the school, attacking a 13-year-old student at Larsen Middle School. That case also is ongoing in Kane County's juvenile court.

Facio, of the 600 block of Jefferson Street, is scheduled to appear in a Kane County court again May 28 before Judge Allen Anderson.

His mother, Sinthia, also was in court Friday on drug offenses, for which she is serving probation.
