Two options for Elgin driver in deadly DUI
An Elgin man is expected to stay in jail or be confined in a drug and alcohol abuse program until he is sentenced in a fatal drunken-driving crash, his attorney said Wednesday.
Brian M. Poliarny, 19, could undergo an evaluation in the next two days to determine if he can enroll in an inpatient program, said David Kliment, the county's public defender.
If Poliarny is not accepted, it's not likely that he will win an opportunity to leave the Kane County jail before his sentencing set for Jan. 3, Kliment said.
Poliarny, of the 1000 block of Biltmore Drive, was taken into custody last week after he failed three drug and alcohol tests in a month, according to court records.
On Nov. 5, a Breathalyzer revealed Poliarny had drunk alcohol. The next day, a urinalysis test returned positive for marijuana. Poliarny also tested positive for marijuana on a Dec. 6 urinalysis test, court records show.
He is due in court again on Friday. Judge Grant Wegner likely will rule if Poliarny stays in jail or will be admitted into a treatment facility until his punishment is meted out, prosecutor Greg Sams said.
Poliarny has pleaded guilty to two counts of aggravated drunken driving for crashing his car into the side of Haeger Potteries building in East Dundee on Jan 12. Roman Pokorny, 16, was killed and another passenger was injured.
Prosecutors had charged Poliarny with murder, an offense that was thrown out in August after Wegner ruled the teenager might have tried to hit the brake before he slammed into the building.
