Campton Hills foes dealt new legal setback

Proponents of disconnection from the village of Campton Hills suffered another setback when Kane County Circuit Judge Michael J. Colwell dismissed a petition for disconnection brought by, among others, CJR Enterprises Inc.

Colwell ruled Thursday that the petitioners failed to provide the notice to taxpayers required by Illinois law. Upon the motion of Campton Hills village attorneys Hal R. Morris and Georgia Logothetis of Arnstein and Lehr, the court dismissed the disconnection petition in its entirety.

This occurred after the petitioners conceded they had spent more than $27,000 on two expert witnesses and attorney fees to file the petition.

This latest setback comes days after proponents of disconnection admitted the petitions they were circulating for dissolution of the village were defective, forcing them to make another attempt to collect the requisite number of signatures to put the measure on the ballot.

"These efforts would be best spent on bringing the community together, rather than trying to tear it apart," Village President Patsy Smith said in a prepared statement.

The village was established May 14 after 55 percent of voters approved incorporation.
