Suspects in West Dundee bust must show bail money is legal

Two men arrested in a drug-related shooting in West Dundee last week will have to prove their bail money comes from legal sources.

Kane County prosecutors have filed motions requiring Marcos Rojas and Richy D. Sanchez to prove the source of their bond money after they were arrested after a drug deal with undercover agents went bad, and Rojas was shot after his car was stopped at Route 72 and Sleepy Hollow Road.

Bail for Rojas, 27, of the 5700 block of Christiana Avenue, Chicago, has been set at $2 million and he is awaiting transfer from a hospital to the Kane County jail. He was charged with armed violence, possession of a controlled substance with intent to deliver and possession of a controlled substance.

"The defendant was in possession of cocaine with a street value of $110,000," prosecutors wrote. "The defendant indicated to police that he was unemployed. His lack of income is inconsistent with his ability to post the funds need(ed) to be released on bond."

Sanchez, 25, of the 1300 block of Cunat Court, Lake in the Hills, was being held on $750,000 bail. He faces the same charges as Rojas. According to prosecutors, Sanchez also is unemployed, has no driver's license and should prove his bond money comes from legal sources.

According to prosecutors, Rojas and Sanchez met undercover officers and agents from the Drug Enforcement Administration and Homeland Security Investigations to purchase cocaine May 17 in the parking lot of a hotel near Interstate 90 and Randall Road in Elgin.

During the meeting, Rojas and Sanchez fled in their vehicle with about 900 grams of cocaine, prosecutors said, and unmarked police vehicles followed with emergency lights flashing.

The vehicles stopped at Route 72 and Sleepy Hollow Road. Rojas then sped toward a police officer, who shot into the vehicle and hit Rojas, authorities said.

A handgun was found in Rojas' vehicle, prosecutors said.

Sanchez is next due in court June 7.

If convicted of the most serious charge, each faces a minimum of 15 years in prison.
