Woman on 'last chance' probation over prescription pills arrested in Elgin

A 41-year-old Fox Lake woman accused of trying to illegally obtain prescription drugs over the weekend in Elgin could face upgraded charges based on her past convictions.

Colleen L. Bagley was arrested Sunday on a felony charge of trying to illegally obtain the pills from an Elgin pharmacy.

Bagley was on parole after her March 2016 release after serving half a four-year prison term that she received for violating her probation. She spent a year in prison and got credit for nearly a year served in jail that also was applied to the four-year term.

A Kane County judge told Bagley it was her "last chance" in April 2014 when he sentenced her to five years' probation after she was arrested three times within a year on charges she illegally tried to obtain prescription drugs.

"Either you'll be dead or in prison," Judge James Hallock said at the time of the sentencing when Bagley faced up to 16 years in prison.

She lasted less than a year of probation before being arrested on charges of defrauding a drug screening test in Kane County and was sentenced for her probation violation in March 2015, records show. Bagley was being held on $30,000 bail after her most recent arrest and could be headed back to prison for a parole violation.

According to an Elgin police report, an officer was dispatched to Meijer, 815 S. Randall Road, at about 3:17 p.m. for a fraudulent prescription and saw Bagley walk past him as she left the store. She resisted arrest in the parking lot and after being read her Miranda rights, admitted to not knowing who the doctor was who wrote the prescription and using a form with another woman's name on it, the report said.

As of now, Bagley is charged with one felony count of possession of a blank or counterfeit prescription form - first offense, and misdemeanor resisting arrest, according to Kane County court records.

Authorities could upgrade the charges based on her criminal history, which includes convictions for forgery in Lake and DuPage counties.

The Kane County state's attorney's office declined to comment Tuesday.
