$300K bail set in South Elgin home invasion, shooting

Bail was set at $300,000 Monday for one of two suspects arrested in a home invasion in South Elgin over the weekend in which the homeowner wrestled away a gun and shot one intruder.

Michael T. York, 51, of the 300 block of South Collins Street, South Elgin, was on probation for a 2013 drug offense when he was arrested in connection with the attack, which authorities say occurred late Saturday night on the 300 block of Windsor Court.

York and another man, Alan Span, 43, of the 300 block of Kathleen Drive, Elgin, were charged with felony home invasion and aggravated battery.

Police said the homeowner and a friend were entering the house through an attached garage when two men came up behind them. York is accused of hitting the homeowner in the face with the butt end of a gun, fracturing his eye socket. The victim then grabbed the gun from York and fired a shot at him. The bullet missed York, but hit Span in the leg, police said.

Both men ran off, but police identified York from the homeowner's description of him and previous arrests. Police arrested York at his home and found Span in York's garage, where he was bleeding from a recent gunshot wound, authorities said.

According to Kane County court records, York has felony convictions from a January 1986 robbery, possession of a weapon by a felon in November 2001, and possession of 30 grams to 500 grams of marijuana in July 2013. York was on probation through November 2016 after pleading guilty in the marijuana case.

Span will be taken to the Kane County jail after he is released from the hospital.

If convicted of the most severe offense of home invasion, each faces six to 30 years in prison with no option for probation.
