Waukegan man sentenced to time served and probation for shooting man during argument

A Waukegan man was sentenced to 30 months of probation and 170 days in Lake County jail for shooting a man who was arguing with a family friend, authorities said Tuesday.

Milton Whittington, 58, of the 2500 block of Village Park Drive, was also sentenced to 120 days of periodic imprisonment and 90 days on electronic home monitoring by Lake County Judge George Bridges, Assistant State's Attorney Matt DeMartini said.

Whittington has fulfilled the 170-day sentence because of the time he has spent in jail since the Sept. 28 shooting, DeMartini said. Whittington will also serve 30 months of probation after his release from periodic imprisonment.

He could have been sentenced up to 15 years behind bars for the shooting. DeMartini said he asked for a prison sentence of eight years.

Authorities said Whittington became involved in an argument between the victim and family members and friends in a parking lot in the 2500 block of Village Park Drive about 12:30 p.m.

After being called into the argument by his son, Whittington shot the victim in the stomach, authorities said.

Whittington was taken into custody without incident, authorities said. The gun was recovered by police.

The victim was taken to a hospital, where he was treated for nonlife threatening injuries, DeMartini said. The victim has fully recovered.

Whittington pleaded guilty in February to one count of aggravated discharge of a firearm. Aggravated battery and unlawful use of a weapon charges against him were dropped as part of the plea agreement, DeMartini said.
