2nd lawsuit in fatal 2012 Campton Hills crash over stolen car

A woman who was injured in a fatal 2012 Kane County crash caused by a woman driving a stolen car out of Wheaton has filed a lawsuit seeking damages for negligence.

Erin Pazin, who was a passenger in a car hit by Jennifer M. Liston, of Madison, Wisconsin, has sued Liston's estate and a Wheaton man for not stopping Liston from driving.

Liston was killed in the Dec. 1 head-on crash, as was Pazin's boyfriend, Zachary Bingham, 18, of Maple Park, and his dog.

Pazin was 19 at the time and living in Elburn.

Bingham's survivors also have filed a wrongful-death lawsuit against the Kane County sheriff's department, arguing a deputy was negligent in chasing Liston.

Defense attorneys for Deputy Nicolas Wolf have denied in court documents that Wolf was pursuing Liston, records show.

That case is due in court Dec. 17.

Pazin's lawsuit, filed in Kane County, seeks unspecified damages from Liston's estate and argues she was negligent when she crossed the centerline while headed west on Route 38 in Campton Hills.

Pazin, who now lives in Elgin, also named Bruce A. Greenberg, of Wheaton, as a defendant in the lawsuit.

According to the lawsuit, Greenberg watched Liston drink beforehand and was negligent in not stopping her from driving.

"It was then and there the duty of Greenberg to exercise ordinary care in the entrustment of his 2003 Nissan Altima and to deny permission to Liston when he knew Liston was a reckless driver due to her intoxication," the suit states.

Mary L. Johnson, who is Pazin's attorney, could not immediately be reached for comment.

Pazin's lawsuit is due in Kane County court Feb. 19.
