Elgin man charged with aggravated DUI in fatal Friday crash

An Elgin man has been charged with aggravated driving under the influence of alcohol resulting in death after a Friday-afternoon crash caused the death of a passenger, police said.

Jose C. De La Torre, 53, appeared in Kane County bond call court Saturday morning. Bail was set at $250,000, meaning he must post $25,000 to be freed.

The name and age of his passenger have not been released by Elgin police because his family has not been notified. An autopsy is scheduled for Monday.

The single-vehicle crash happened at 2:01 p.m. at Larkin and Highland avenues. The vehicle hit a tree. Both men left the scene, but were found shortly. The passenger died at Presence St. Joseph Hospital in Elgin.

De La Torre lives in the 0-100 block of North Jackson Avenue.

The charge is a Class 2 felony. If found guilty, he could be sentenced to 3 to 14 years in prison.

He was also charged with aggravated driving under the influence, a lower-class felony, and driving an uninsured motor vehicle - bodily harm accident, a class A misdemeanor.
