8 years prison for Elgin man's 6th DUI, crash
An Elgin man has been sentenced to eight years in prison after pleading guilty to his sixth DUI in which his blood-alcohol concentration was nearly three times the legal limit.
Jesus Pacheco, 56, of the 200 block of Dexter Avenue, faced six to 30 years prison on the felony charge of aggravated DUI, according to Kane County court records.
Judge John Barsanti accepted the plea. The sentence also includes a $5,000 fine.
Pacheco was arrested Jan. 1 after he struck a parked car on Gifford Street with his 2002 Subaru, according to court records. Pacheco admitted to police that he drank six beers; his blood-alcohol concentration registered .229, and the legal threshold is .08.
He also was cited for not having insurance; information on his previous arrests was not immediately available.
Pacheco can have his sentence cut in half for good behavior while behind bars. He also gets credit for 270 days served at the Kane County jail while the case was pending. He also will be on parole for three years.
A message left seeking comment from the Kane County public defender's office, which represented Pacheco in the case, was not returned.
