Man charged with breaking into ex-girlfriend's apartment, stealing Playstation 3 gets probation

A 24-year-old man accused of breaking into his ex-girlfriend's North Aurora apartment and battering her and her new boyfriend before stealing a Playstation3 has pleaded guilty to a reduced charge and released from jail.

Irvin Bernal, of the 1000 block of Spruce Lane, Aurora, last week pleaded guilty to felony burglary and was sentenced to 180 days in jail, three years probation, and ordered to pay $2,710 in fines and court costs, according to Kane County court records.

Bernal was held at the Kane County jail for 315 days since his arrest, so was released after his plea deal was accepted by Judge James Hallock.

Kane County prosecutors dismissed the most severe charge of home invasion causing great bodily harm, and criminal damage to property and domestic battery, records show.

According to police, Bernal kicked in the window screen of the woman's apartment at about 2:45 a.m. June 4, 2015, and attacked the 21-year-old woman and her 22-year-old male companion.

Bernal also damaged a television and table before grabbing the video game console and running off. He was arrested a short time later near Lilac Lane and Butterfield Road, police said. Both victims had minor injuries but refused treatment.

Bernal can be resentenced to up to seven years in prison if he violates his probation.
