Probation for two in Carpentersville party fight

A pair of Carpentersville men were sentenced to a year of probation each after pleading guilty to charges alleging they jumped another man outside a party in July 2014.

Daniel Mora, 24, and Jose A. Mora-Aguilar, 27, both of the 200 block of Enesenda Circle, admitted to aggravated battery, a felony, just before their bench trial before Judge John Barsanti was about to begin last week, according to Kane County court records.

They were accused of attacking a man outside a party on the 500 block of Tyler Drive in Carpentersville, kicking him while he was down and breaking his nose.

Under the plea agreement, each was fined $1,280, ordered to have no contact with the victim and to attend anger management counseling, and issued a year of conditional discharge, which is a form of probation.

Prosecutors also dismissed the less serious felony charges of mob action.

It was not immediately clear if Mora and Mora-Aguilar were related.

Caroline Hernandez, the defense attorney for the Carpentersville men, did not return a phone call seeking comment.

If either of the two violate their probation, they could be resentenced to up to five years in prison.

Nicasio Oropeza, owner of Nico's Hair Salon at 308 S. McClean Blvd., recently paid $1,378 to Monika Valdivia, who sued on behalf of her daughter.

Valdivia initially filed a lawsuit seeking more than $50,000 in damages in the April 10, 2014, incident, according to court records, and her attorney said the girl had to go to the hospital and get staples in her scalp.

Kane County Judge James Murphy approved the settlement.
