Batavia man accused of breaking into home, attacking friend

A Batavia man has been charged with home invasion and aggravated battery, accused of forcing his way into a friend's neighboring home and fighting with him.

Jose E. Garcia, 31, of the 700 block of Walnut Street, used a shoulder to break open the neighbor's door early Wednesday morning, according to police.

Police say the victim reported the attack at 3:10 a.m. The victim, 29, was treated at a hospital for non-life-threatening injuries and released.

Garcia is in the Kane County jail. He appeared in bond court Wednesday afternoon, but the amount of bond set was not immediately available as of late Wednesday afternoon.

Home invasion is a Class X felony, punishable by six to 30 years in prison. Aggravated battery is punishable by one to three years in prison.

Police say the two fought over "personal" matters, but declined to say exactly what the issues were.
