2nd Campton Hills ballot challenge continues

A Campton Hills man plans to file an updated challenge to the write-in candidacies of Village President Patsy Smith and three people on her slate.

Kane County Judge David Akemann Thursday dismissed a challenge submitted by James Newman without commenting on its merits, but he allowed Newman to file another complaint.

Newman argues Smith's candidacy papers and those of three others on her slate are invalid because they were turned into the interim village clerk at his home instead of village hall.

"What we're arguing is you can't have anybody write in anybody," Newman said. "One way or another, I am entitled to have my day in court on this issue and that's all I'm asking."

Opposing attorneys say Smith and her slate only needed to submit papers to Kane County Clerk Jack Cunningham.

"He's barking up the wrong tree," said Ken Shepro, an attorney who represented Smith in a different challenge earlier this year.

Smith is seeking her third, 4-year term for Campton Hills president as a write-in candidate in the April 7 election.

Harry Blecker, who has elected village trustee in spring 2013, is running for village president as well.

Laura Andersen, Susan George and Michael O'Dwyer are running for trustee as part of Blecker's slate. Nicholas Girka also is a candidate for village clerk.

Smith's slate includes Steven Galloway for trustee, along with write-in candidates Don Sheluga and Mike Turgeon for trustee, and write-in candidate Stephany Impson for village clerk.

As of late Thursday afternoon, Newman had not filed his complaint, so the next court date was not available.
