Carpentersville man almost framed in theft now guilty of making false report

A man who was almost framed by a former Elgin cop for a 2011 cellphone theft has pleaded guilty to calling 911 more than a dozen times in 2013 and was sentenced to probation.

Jose A. Ares-Torres, 37, of the 300 block of Amarillo Drive, Carpentersville, pleaded guilty last month to a misdemeanor and was sentenced to 11 months probation and fined $500, according to Kane County court records.

Ares-Torres was accused of calling 911 about a dozen times while drunk in September 2013 and then hanging up.

If he violates probation or gets arrested in the next year, he could be resentenced to up to a year in prison.

His defense attorney, George Irizarry, did not return a phone message seeking comment.

Ares-Torres was arrested in April 2011 in Elgin and charged with beating up a man and taking his phone.

Kane County prosecutors later dropped the charges of felony robbery and aggravated battery a few days later after the officer admitted to planting evidence on Ares-Torres so he could look good in the investigation and get promoted.

The officer, Michael Sullivan, was charged with felony misconduct and resigned from the police department. He eventually pleaded guilty to reduced charges of misdemeanor obstruction of justice and was sentenced to a month in jail and 200 hours of community service.

Ares-Torres sued Sullivan for damages, but Sullivan filed for bankruptcy in December 2011 and the suit was dropped.
