Former Elgin woman in trouble after 'last chance' probation

A former Elgin woman who received probation after three prescription drug arrests within a year is in trouble again and could be sent to prison.

Colleen L. Bagley, 39, now of Fox Lake, is accused of trying to defraud a urine test and was arrested last summer in Lake County on charges of burglary, forgery, identity theft and possession of a controlled substance, according to court records.

Bagley was being held at the Lake County jail on $100,000 bail and is due in court Feb. 24.

If convicted of burglary, the most severe of the charges, she faces up to 15 years in prison.

Calling it her "last chance," Kane County Judge James Hallock gave Bagley five years of probation in April 2014 after she pleaded guilty to prescription drug forgery and possession charges.

"Either you'll be dead or in prison," Hallock said at the time.

Bagley, now of the 7400 block of Dunwood Court, had been arrested three times within a year, including a drug arrest on the same day she bonded out from the Kane County jail on another drug charge.

Kane County prosecutors have begun violation of probation proceedings, citing not only the Lake County charges, but a July 29, 2014, incident in which Bagley was charged with trying to defraud a drug test that was part of her probation, court records show.

Bagley is accused of bringing a condom filled with urine into the test, records show. The test administrators found the condom in the toilet and the attempt was considered an automatic positive test. She later was retested, and cocaine, opiates, codeine, and morphine were found in her system, according to Kane County prosecutors.

Bagley was in Kane County court earlier this month and is next due in court Jan. 29.

Bagley faces up to 16 years in prison if a judge rules she violated her probation

Bagley's defense attorney James McClain declined to comment.
