Elgin teen who accosted woman on trail gets probation

A 19-year-old man was sentenced to 18 months probation after admitting to accosting of a woman walking on the Fox River Trail in April, according to Kane County court records.

As part of the plea agreement reached last week, Ulises C. Bibriescas, of the 500 block of Raymond Street, Elgin, also must pay $2,090 in fines and fees, records show.

If he violates probation, Bibriescas could be resentenced to up to five years in prison, but incarceration would be unlikely because the women were not seriously injured.

Bibriescas was arrested on April 25 on misdemeanor charges he slapped the buttocks of a 45-year-old woman from Elgin as she walked along the Fox River Trail in South Elgin.

A 60-year-old woman from St. Charles was similarly assaulted while running April 18 west of the river on the Fox River Trail; no one was caught, but she identified Bibriescas later in a lineup, police said.

Bibriescas was initially charged with misdemeanors, but a grand jury in May handed down felony indictments because the offenses took place in a public and one victim was older than 60.

Judge John Barsanti accepted the plea in which prosecutors dismissed felony charges of aggravated battery and aggravated battery to a person 60 or older from the April the second incident, records show.

A message left with Thomas Young, Bibriescas' defense attorney, was not immediately returned.
