Man charged with raping woman at Elgin hotel

A 34-year-old man has been charged with raping a woman who had passed out from drinking at an Elgin hotel in February, according to police and Kane County court records.

Roger D. Eason of Elgin, was arrested by U.S. marshals on Saturday for a parole violation and also was charged with felony criminal sexual assault.

Eason, of the 300 block of McClure Avenue, is being held on $255,000 bail, meaning he must post $25,500 to be free while the case is pending.

According to an Elgin police report, Eason is accused of sexually assaulting a 34-year-old Elgin woman at a hotel Feb. 23, after she passed out from drinking too much.

According to the report, two witnesses said they, the victim and Eason had drinks at a downtown Elgin bar and went to a nearby hotel on the 1500 block of Lexington Avenue for sex. The victim, the report said, was severely intoxicated and went to the hotel only so she could pass out, which she did - fully clothed.

The victim told police she woke up and discovered Eason removed her pants and was having sex with her, police said. She immediately told him to stop and ran to the bathroom. The two witnesses told Eason to leave, the report said.

Four days later, the victim told police she passed out at the hotel, did not have any intention to have sex with Eason and never gave consent, police said.

The two witnesses told police the victim was passed out, was unaware of what was happening and that they saw Eason assault the woman, the report said.

Eason told police he and the woman, who he said was drunk, began having sex when she said, "You're not my boyfriend, this isn't right," grabbed her clothes, went to the bathroom and then told him to leave, the report said.

Eason is next due in court June 4 and faces up to 15 years in prison if convicted.

According to court records, Eason has served time in prison twice for felony aggravated battery along with retail theft and possession of a controlled substance, according to court records.

He also has arrests for domestic battery, marijuana possession, resisting arrest and assault, records show.
