10-year prison sentence for 2012 Elgin hotel rape

A 38-year-old Missouri man was sentenced to 10 years in prison Friday for a November 2012 rape at an Elgin hotel, prosecutors said.

A Kane County jury in November 2013 convicted Mudy A. Munoz-Salgado, of the 300 block of Locust St., Eldon, Mo., of criminal sexual assault even though the victim did not testify.

Munoz-Salgado was in town for a construction project when he forced a Missouri woman into a room Nov. 13, 2012, at the Lexington Inn, 1585 Dundee Ave., Elgin. The woman had come to visit her boyfriend, who also was one of Salgado’s co-workers. She could not be located to testify during a November 2013 trial, but prosecutors forged ahead and secured a conviction.

Judge Clint Hull issued a seven-year sentence for the sexual assault and a three-year sentence for unlawful restraint. The sentences must be served one after the other.

Under state law, he must serve 85 percent of his rape sentence and 50 percent of the unlawful restraint sentence, which is a total of about 7½ years in prison. He also must register as a sex offender for the rest of his life.

Munoz-Salgado gets about 15 months credit toward his sentence for being held at the Kane County jail on $3 million bail, which was revoked when he was convicted last year.

Munoz-Salgado faced a maximum sentence of 35 years behind bars.
