Judge: Schaumburg man’s arrest legal

A motion to throw out the arrest of a man accused of robbing a Schaumburg business at gunpoint in 2009 was denied Tuesday, moving the case toward trial later this summer.

Martino Jackson, 38, of Schaumburg, is charged with taking more than $1,000 from the Schaumburg Recycling Co. on the 1100 block of Lunt Avenue.

His attorney, Assistant Cook County Public Defender Calvin Aguilar, argued that Schaumburg police failed to secure an arrest warrant when they took Jackson into custody Jan. 24 near his home on the 100 block of Dickens Way.

The defense motion also aimed to bar from trial evidence recovered as a result of the arrest. Police said they found a .22-caliber handgun inside Jackson’s home.

Prosecutors said an anonymous informant tipped police off to Jackson’s alleged involvement in the Dec. 9, 2009 holdup.

Jackson faces armed robbery and unlawful use of a weapon charges that could land him as much as 30 years in prison if convicted.

Judge Thomas Fecarotta ruled police had probable cause to arrest Jackson, thanks to the information supplied by the informant.

Jackson is scheduled to return to court July 20s. He’s currently on parole and has a criminal history that includes a 2005 conviction for armed robbery where he served eight years and six months in prison.
