Elgin police find gun from 2008 shooting

New criminal charges have been filed against an Elgin man accused of shooting his ex-girlfriend in the back more than a year ago.

Police said they recently recovered the gun Bernardino Hernandez, 22, used in the June 26, 2008, shooting, and four new charges were filed against him as a result.

Hernandez, of the 800 block of South Liberty Street, was arrested on New Year's Day after police found him possessing a gun in violation of bond in his attempted-murder case, according to the Kane County State's Attorney's office. Police said they later tied the weapon to the shooting.

Over the weekend, Hernandez was charged with two counts of aggravated unlawful use of a weapon and one obstructing justice charge accusing him of concealing evidence. He had been free on bond since last September, after Judge Timothy Q. Sheldon reduced his bond from $1 million to $150,000.

His defense attorney, Sandra Byrd, said she had little information on her client's latest arrest as of Monday afternoon and declined to comment further.

Police have said Hernandez approached the victim in her bedroom shortly after 3 a.m. and fired multiple rounds, hitting her three times in the back as she attempted to take cover. The shooting followed an argument over custody of their child, according to acquaintances.

Hernandez is scheduled to stand trial Jan. 25 on charges of attempted first-degree murder and aggravated battery with a firearm, according to court records. He was being held in the county jail Monday on $1 million bond.
