Wrongful-death suit filed in Aurora crash that killed pedestrian

A wrongful-death and negligence lawsuit has been filed against a motorist who struck and killed a 67-year-old pedestrian in Aurora last month.

The Kane County lawsuit seeks unspecified damages from Guadalaupe Luna, 75, of Aurora, who received a traffic citation but was not charged criminally in the March 11 case.

According to police and the lawsuit, Luna was headed south on Farnsworth Avenue at 6:16 p.m. when his 1996 Chevy truck struck and killed George Edwards, who was headed west in a pedestrian crosswalk attempting to cross Farnsworth at Marshall Avenue.

The lawsuit, filed by Edwards' son, argues that Luna, who was ticketed for failure to yield for a pedestrian in a crosswalk, should have seen the crosswalk warning signs and acted with more caution.

"It was the duty of the defendant to operate his motor vehicle with due care and caution for all pedestrians on the roadway and intersections, including George Edwards," read part of the lawsuit. "As a result of the one or more of the a foregoing negligent acts or omissions of the defendant, George Edwards suffered grave injuries that lead to his death."

The lawsuit is next due in court on June 23.

Luna is due in traffic court on May 26 on the traffic citation. His attorney on that case, Paul Akidas, did not return a message Wednesday. It was not immediately known if Akidas was representing Luna on the wrongful-death lawsuit.
