Elgin man accused of raping woman groggy from pain meds

A 34-year-old Elgin man is accused of raping a woman last week while she was groggy from pain medication, according to police and court records.

Crescencio Heredia, of the 800 block of Van Street, has been charged with two counts of criminal sexual assault, two counts of criminal sexual abuse and two counts of possession of a firearm without a Firearm Owner's Identification card, according to Kane County court records.

Heredia was arrested last weekend after the victim told police she was assaulted by Heredia, according to a police report.

The woman told police she was asleep in her bedroom at about 2 a.m. Oct. 7 and had taken prescribed pain medication, according to a police report.

Heredia was at the woman's residence in Elgin drinking beer. The woman woke up to Heredia fondling her and sexually assaulting her even though she told him to stop, the report said.

Heredia stopped, fell asleep for a little bit but woke up again and began doing the same thing, the report said.

Heredia was arrested two days later in Pingree Grove after the woman told police what happened.

Authorities also seized two guns and ammunition from his residence because "defendant is an illegal alien and unable to possess a Firearm Owner's Identification card," the police report said.

Heredia was being held on $150,000 bail, meaning he must post $15,000 to be released from the Kane County jail while the charges are pending.

If convicted, he faces up to 15 years in prison, along with possible deportation.
