Plea deals coming in siblings' videotaped arrests?

The trial of two siblings charged with resisting Wheeling police officers in a June arrest captured on video was postponed Thursday, and it appears at least one of the defendants may be headed for a plea deal.

Defense attorney Peter Lewis said his client, Ashley Rodriguez, likely will settle her case out of court and not serve any time beyond what she spent in custody at the Wheeling police station after her arrest.

"It'll be settled without a trial," Lewis said.

Rodriguez, 21, of the 5400 block of North East River Road in Chicago, and her brother, Christian Ruiz, 19, of the 700 block of North Wolf Road in Wheeling, were charged with resisting an officer after an altercation with police June 6 outside an apartment building at 87 N. Wolf Road.

Their mother later claimed police used excessive force during the confrontation, and an amateur video of the arrest was posted online. An internal review by Wheeling police cleared officers of the excessive force allegations.

The arrests occurred after police responded to a call of a group of people fighting in front of the Wolf Road apartments at 7:42 p.m. June 6. A police supervisor reported seeing Ruiz and a juvenile walking away from the scene at a fast pace, and identified both as known gang members, police said.

According to police, Rodriguez then approached the group and refused to stand more than 10 to 12 feet away when an officer asked her to step back. Rodriguez then resisted when officers tried to arrest her, reports state.

While police were arresting Rodriguez, Ruiz tried to intervene, and officers pushed him against a wall, took him to the ground and handcuffed him, reports state.

Ruiz is charged with aggravated assault in addition to resisting. Both he and Rodriguez are scheduled to return to court Nov. 12.
