Suit filed over Dist. 34 kindergarten fee

A lawsuit filed against Winfield School District 34 Monday claims the district's fee for all-day kindergarten is unconstitutional.

The Evan Law Group filed suit yesterday on behalf of Elizabeth Triebel to stop the district from charging tuition of $2,416.50 per child for the full-day kindergarten program, according to a release.

The suit alleges that charging for the full-day kindergarten is in violation of the free education clause of the Illinois Constitution and the Illinois School Code.

According to the release, the district has said that it is entitled to charge tuition because the full-day program is not required and is the equivalent of an extracurricular program.

An initial hearing is scheduled for June 16.
