September trial set for St. Charles man accused of baby sitter attack

A Sept. 17 jury trial has been set for a St. Charles man accused of raping his infant son’s baby sitter in November 2010.

Michael L. Listy was arrested at his apartment in the 1000 block of South Second Street after the victim called police and put her cellphone down to allow dispatchers to hear the assault and trace the signal, authorities have said.

Listy, 32, is on electronic home monitoring at his parents’ Geneva home and faces up to 30 years in prison if convicted.

He is charged with six counts of aggravated criminal sexual assault and six counts of criminal sexual assault, according to court records.

Listy’s defense attorney, Liz Lovig, has said both Listy and the baby sitter were drinking alcohol and smoked marijuana that night.

Lovig said the pair were playing a drinking game, and they had had consensual sex on previous occasions, including earlier that night.

Lovig also said medical reports indicate no physical injuries to the baby sitter.

Kane County Judge Allen Anderson will oversee the trial.
