Cary man found not guilty of attempted murder

A jury has ruled that while a Cary man did ram another man with his car, he didn’t intend to kill him.

Michael W. Rohn, 24, was found not guilty of attempted murder Thursday after a jury deliberated for more than three hours. But jurors found Rohn guilty of three counts of aggravated battery — all felonies — for which he could face up to five years in jail.

Prosecutors said Rohn and a passenger in his Jeep Wrangler entered a McDonald’s drive-through in Cary around 4 a.m. on Oct 16, 2010. In front of them was a Chevrolet Tahoe, and one of the four individuals in the car is accused of making an obscene gesture at Rohn and his passenger.

Rohn followed the Tahoe to a nearby parking lot behind a Walgreens, where officials say one of the Tahoe’s passengers, Jeremy Sojka, got out of the car to confront Rohn. The two punched each other while Rohn remained in the car.

Prosecutors said Rohn backed out of his spot and struck Sojka twice with his car, pinning him against the Tahoe. Sojka’s injuries included a lacerated liver, broken pelvis and broken femur.

Rohn is scheduled to be sentenced Aug. 12.
