St. Charles jeweler says all but 2 diamonds sold

A St. Charles jeweler who his going out of business told a Kane County Judge Thursday that he’s sold all but two diamonds out of some $80,500 in loose diamonds that a wholesaler claims it’s owed.

“If that’s true or not true, we’re going to find out,” said Robert Dawidiuk, attorney for the Chicago-based R.S. Diamonds, which is suing Diamond-Mart of St. Charles and its owner, Randall Matz, for breach of contract.

“Right now we’re looking for (Matz) to return the diamonds if he has them. If not, we’ll look at all remedies,” Dawidiuk said.

Matz told Kane County Judge Kevin Busch that the two remaining diamonds are worth about $140 and are part of an earring set.

Busch barred Matz from selling the earrings, but the liquidation sale may continue at Diamond-Mart as long as the diamonds in question by R.S. Diamonds are not sold.

Busch also gave Dawidiuk 10 days to inspect records at Diamond-Mart in St. Charles.

Dawidiuk said his client has given Matz plenty of notice to pay for the diamonds, some of which were shipped to St. Charles back in 2008, but Matz claims he’s not received letters.

“Can I just write him a check for the two diamonds?” Matz said at one point during the hearing.

“I guess you can just write (R.S. Diamonds) a check for ($80,500) because that’s the claim,” Busch responded.

“That can’t happen,” Matz replied.

Matz told Busch Diamond-Mart will declare bankruptcy July 1, but after the hearing said he was only considering it.

“I paid them $142,000 over the past three years for diamonds I’ve purchased. Whether I owe them $80,000, we have to do an accounting of it. That’s why we’ve continued this thing for another month,” Matz said.

Both sides are due back in court June 27.
