Wheaton man faces sexual assault charges

A Wheaton man has been charged with sexually assaulting two women acquaintances by having sex when they were unable to consent — including when one of the victims was intoxicated.

Matthew Alexander Tumbarello, 19, of the 200 block of West Illinois Street, appeared before DuPage County Judge Brian Telander Wednesday morning.

Tumbarello's girlfriend went to Wheaton police in early July to report she had been assaulted and videotaped.

“The allegations that Mr. Tumbarello took advantage of several women who were unable to consent and secretly videotaped the sexual assaults are beyond disturbing and will be met with the full force of the law,” State's Attorney Robert Berlin said in a news release. “An individual's right to privacy does not end simply because they are in a relationship with another person.”

Tumbarello is accused of assault, eavesdropping by recording a conversation without consent and videotaping through/under clothes to see the first victim's body or underwear, at 11:54 a.m. Dec. 9, 2019.

Tumbarello is charged with assaulting and video recording the second victim, who was naked, at 1:24 a.m. May 20, in Wheaton.

He also is charged with video recording a third woman, who was naked, without her consent at 10:34 a.m. Aug. 13, 2019, in Bloomingdale.

The assault charges allege the victims were unable to understand the nature of the sexual act or were unable to give knowing consent.

Telander denied prosecutors' motions to increase Tumbarello's bail to $100,000 and to have Tumbarello wear a GPS monitor.
