Aurora man faces prison after fifth DUI arrest

An Aurora man has been arrested and charged with his fifth DUI arrest after he was found passed out with his car's engine running, according to Aurora police and court records.

Adam Cervantes, 37, of the 1200 block of Superior Street, faces charges of aggravated DUI/fifth offense, aggravated DUI-no insurance, aggravated DUI-no license and driving while license suspended/fourth to ninth offense stemming from a traffic stop Saturday, according to Kane County court records.

If Cervantes is convicted of aggravated DUI/fifth offense, he faces a sentence of four to 15 years in prison with no chance of probation.

Aurora Police spokesman Paris Lewbel said officers responded to a call at 5:21 a.m. for a suspicious vehicle that had been in an alley on the 300 block of LaSalle Street for about 30 minutes. Police found Cervantes asleep behind the wheel, keys in the ignition with his foot on the brake.

Police turned off the car before waking up Cervantes, who smelled of alcohol, failed field sobriety tests and refused a chemical test, Lewbel said. No one was injured.

According to court records, Cervantes was arrested and charged with his first DUI in September 2005 in Aurora with a blood-alcohol concentration was .148; the legal threshold in Illinois is .08. Cervantes pleaded guilty, was sentenced to supervision.

His next DUI arrest was in December 2013, also in Aurora. According to court records, he crashed into another car on the way home from a bar and was later sentenced to 15 days in jail and 18 months of conditional discharge.

In September 2015, Cervantes was arrested and charged with DUI after a crash and he was sentenced to 15 days in jail, two years of probation and 90 days of an alcohol monitoring device after pleading guilty, records show.

Aurora police arrested Cervantes and charged him with his fourth DUI at 3:11 a.m. Nov. 4, 2016, after he struck a parked vehicle on the 300 block of North Avenue and authorities found him asleep behind the wheel, court records show. He pleaded guilty and was sentenced a three-year prison term, of which he served half, records show.

Cervantes is held at the Kane County jail on $100,000 bail, meaning he must post $10,000 to be released while the case is pending. He is next due in court Friday.
