Two charged in Aurora shooting, chase

Two 18-year-olds have been charged in the shooting of another teen on Aurora's east side that ended with a car chase Tuesday.

The victim, a 16-year-old boy, was hospitalized with life-threatening injuries.

Jose M. Soto, of the 200 block of Butterfield Road, North Aurora, is charged with armed violence, three counts of aggravated battery/discharge a firearm, aggravated unlawful use of a weapon and delivery of 10 to 30 grams of cannabis, according to Kane County court records.

Aurora police spokesman Paris Lewbel could not confirm whether the shooting occurred during a drug deal. “It's still under investigation,” he said.

Diego Rubio, of the 600 block of Gladstone Avenue, Aurora, is charged with felony aggravated fleeing/eluding police and nine traffic offenses, court records show.

Officers responded to the 600 block of Second Avenue about 4:15 p.m. Tuesday and found the victim with multiple gunshot wounds.

Rubio is accused of running several stop signs, reckless driving, and going 70 mph in a 30 mph zone in a 2009 Nissan Altima during a four-minute chase that ended near Summerhill Drive and Jericho roads in Aurora Township.

Soto is being held at the Kane County jail on $300,000 bail and must post $30,000 to be released while the charges are pending. If convicted of the most severe charges, he faces six to 30 years in prison, plus additional penalties because a gun was used. He is next due in court Thursday.

Rubio is being held at the Kane County jail on $50,000 bail and must post $5,000 to be released. If convicted of aggravated fleeing, he faces a sentence ranging from probation to up to three years in prison. His next court date is Wednesday.
