5 1/2 years prison for Cary woman four times legal limit in 4th DUI

A Cary woman has been sentenced to 5½ years in prison after pleading guilty to her fourth DUI offense in which she was more than four times over the legal alcohol limit.

Claudia S. Peters, 53, pleaded guilty Tuesday to two counts of aggravated DUI, a felony with a punishment ranging from probation to up to seven years in prison, according to prosecutors and McHenry County court records.

According to prosecutors, an officer with the McHenry County Conservation District pulled over Peters on Sept. 13, 2017, after witnessing several traffic violations.

Police arrested Peters on a DUI charge, and a blood draw showed her blood-alcohol concentration to be .387. The legal BAC threshold in Illinois is .08.

She was charged with a felony after further investigation into Peters' driving records showed she had three previous DUI arrests.

Peters also had a DUI arrest in April 2017 in Cary that was upgraded to felony aggravated DUI after her September arrest, records show. In the April 2017 arrest, a witness called police after seeing Peters driving erratically and she was arrested and charged with DUI, but refused a breath test.

Under state law, Peters can have her prison sentence cut in half for good behavior. She also gets credit for 48 days served at the jail while the case was pending.

McHenry County Judge Sharon Prather accepted the plea agreement, which also requires Peters to pay $3,604 in court fines and fees, court records show.
