3 years' prison for Elgin man's 4th DUI conviction

An Elgin man arrested earlier this year for the sixth time on charges of driving under the influence has been sentenced to three years in prison after pleading guilty to a reduced charge.

Byron J. Roe, 25, of the 12N400 block of Tina Trial, was charged in June with his sixth DUI after a traffic stop in Elgin.

According to police, an officer was responding to a report of a domestic disturbance and found Roe driving a Plymouth Voyager minivan on Hawthorne Street in Elgin. Police said Roe failed several field sobriety tests and "admitted to consuming six Xanax." Xanax is a tranquilizer.

At the time, Roe also was out on bail on another DUI case.

The original felony charge carried punishment of six to 30 years in prison if convicted with no chance of probation, but prosecutors amended the felony charge after a more thorough review of Roe's criminal record.

Kane County Judge John Barsanti accepted Roe's guilty plea this week to felony aggravated DUI-4th offense and prosecutors dismissed additional charges.

The crime was punishable by three to seven years in prison; Roe received the minimum prison term, according to court records.

Under state law, Roe can have his prison term cut in half for good behavior.

He also gets credit for 104 days served at the Kane County jail while his case was pending.
