Wheeling man gets five years for shooting teenage ccyclist

A Wheeling man who authorities say fired at a teenage bicycle rider last year pleaded guilty to aggravated battery causing bodily harm on Monday.

Jorge Magana, 24, pleaded guilty in exchange for a five-year prison sentence, said Cook County Assistant State's Attorney Denise Loiterstein. Magana, who had been held on $2.5 million bail, received credit for 377 days in custody.

The victim suffered scarring as a result of the shooting but no permanent injury or disability, Loiterstein said.

According to witnesses, Magana got out of a car in the intersection of Chelsea Drive and McHenry Road about 6:25 p.m. May 4, 2017, and fired four shots at the then-17-year-old victim, who prosecutors say was riding his bike along with two others.

A bullet struck the 17-year-old in the lower back. The other boys fled, and Magana returned to the car and left with the driver, prosecutors said.

Two witnesses identified Magana as the shooter. Additionally, police recovered four bullet casings from the scene.
