Man faces jail, possible prison for hitting pedestrian in Aurora DUI

A Montgomery man faces jail and possible prison after pleading guilty to his third DUI, the most recent when he struck a pedestrian in Aurora and kept driving.

Richard A. Frost, 48, of the 300 block of North Main Street, pleaded guilty Wednesday to felony aggravated DUI and misdemeanor driving while his license was revoked in exchange for prosecutors dismissing less severe charges.

He was case was set for a jury trial Monday.

The aggravated DUI charge carries a mandatory 90-day jail term, $2,500 minimum fine and a prison term of up to seven years. Judge Linda Abrahamson will sentence Frost March 23.

Kane County Assistant State's Attorney Lori Anderson said Frost was driving through downtown Aurora about 3:54 p.m. Dec. 3, 2016, when he struck and knocked down a pedestrian near Stolp Avenue and Galena Boulevard, but kept driving. The pedestrian, a former state trooper whose arm was injured, and a motorist who witnessed the episode called police and followed Frost's vehicle to a gas station on Lake Street.

Frost failed field sobriety tests and a breath test showed his blood-alcohol concentration was .185, Anderson said. The legal threshold is .08.

Authorities also found an open bottle of whiskey in Frost's coat pocket.

Frost is free on bond and Abrahamson declined to have him jailed until sentencing. Anderson argued Frost was a flight risk and danger to the community. Assistant Public Defender Cecily Carlin noted her client's last DUI was in 2002 and he cares for his disabled wife.

Abrahamson ordered Frost to wear an alcohol monitoring device until sentencing.
