Aurora man sent to prison for 4th DUI, drug possession

An Aurora man was sentenced Tuesday to four years in prison after pleading guilty to his fourth DUI and possession of a controlled substance, which were from two separate arrests in 2019.

Jaime Medina, 49, of the 400 block of Watson Street, was arrested Oct. 7, 2019, and charged with aggravated DUI/5th offense, which is a felony that carries a minimum prison term of four years and a top punishment of 15 years behind bars.

At the time of his arrest, Medina was free on bond from a June 1, 2019, arrest on a felony charge of possession of a controlled substance and resisting arrest, a misdemeanor, according to Kane County court records.

Prosecutors said the fifth DUI charge against Medina was an error and that he had two DUI arrests in 2010 and one in 2013. In the October 2019 DUI arrest, Medina's blood alcohol concentration was .226, prosecutors said.

The legal BAC threshold in Illinois is .08.

Under the plea agreement in which prosecutors dismissed other, less severe charges, Medina was sentenced to the minimum three years on the aggravated DUI charge and the minimum one year on the controlled substance charge, according to court records. The sentences must be served consecutively. Judge D.J. Tegeler accepted the plea.

Medina gets credit for 239 days served at the Kane County jail while his case was pending. He can have his prison term cut in half for good behavior.
