4 years in prison for Elgin man's 5th DUI conviction after 2018 arrest
A 39-year-old man has been sentenced to four years in prison after admitting to his fifth DUI offense, the most recent in Elgin in June 2018.
Juan G. Moncada-Zavala, of the 500 block of North Alfred Street, Elgin, pleaded guilty Thursday to aggravated DUI/5th offense, a felony that carries a sentence ranging from four to 15 years in prison.
Moncada-Zavala was set for a jury trial Monday, which was canceled.
Judge David Kliment accepted the guilty plea, in which prosecutors dismissed other, less severe charges, such as traffic offenses.
Moncada-Zavala was arrested in June 2018 after Elgin police observed him driving erratically, almost striking a parked vehicle. He admitted to police to drinking 12 beers but refused field sobriety tests.
According to court records, Moncada-Zavala was sentenced to three years in prison after pleading guilty to his third DUI from late 2013.
Under state law, he served half that prison term and can have his most recent sentence halved for good behavior as well, court records show.
Moncada-Zavala also gets credit for about a week served at the Kane County jail before he posted $4,500 bond, records show.
