Warrant: Sleepy Hollow teen tried to shoot home invader
The 17-year-old male victim in the April 8 home invasion, attempted murder and rape in Sleepy Hollow tried to shoot Fabian J. Torres, but his shotgun jammed and wouldn't fire, according to a recently unsealed search warrant.
Torres also told investigators he snorted a line of cocaine before attacking the teen and his 19-year-old sister in their house on the 900 block of Saratoga Parkway, according to a police affidavit included in the Kane County court records.
Police also found a receipt for duct tape and rope at Torres' residence nearby on Saratoga that were purchased from Menard's earlier on April 8, which was Torres' 32nd birthday, according to the document.
Torres, who was on parole for aggravated arson at the time, is being held at the Kane County jail without bond on 26 felony charges, including home invasion, attempted murder and aggravated criminal sexual assault.
According to the affidavit, police were called about 12:35 p.m. to a house on Saratoga after a man armed with a knife and carrying a black backpack entered through the unlocked front door.
Torres ordered the brother to sit in the corner of a first-floor room and told the sister to strip and perform a sex act on Torres, according to the affidavit.
Torres pushed her onto a couch, bent her over but she grabbed a knife and all three fought. Both the brother and sister were cut during the scuffle and she ran to a nearby neighbor's house, where authorities were called.
With Torres following close behind, the brother ran upstairs to his father's bedroom, where there was a loaded shotgun.
"(The 17-year-old) attempted to shoot the subject as he was coming at him with the knife, but the gun would not fire," read part of the police affidavit. "(He) started hitting the male with the shotgun, and they started fighting again."
Torres stabbed the teen in during the struggle and left him on a bed before exiting the house. Torres left behind his black bag behind, which contained duct tape, pepper spray, rope, and his cellphone.
Torres was covered in blood when he headed to a neighbor's house on the 700 block of Jamestowne Road, and demanded a ride from people there, the affidavit read. The people there refused to follow Torres' orders and he ran off and was eventually arrested while trying to find a ride.
Torries waived his right to remain silent and told police he went shopping in the morning, ate some food, did a line of cocaine and went to the house to attack the teens, according to the affidavit. Torres acknowledged an image captured on a doorbell camera at the victims' residence was him.
Torres is next due in court May 29 and faces 74 to 245 years in prison if convicted of all charges.
