Man on probation for marijuana conviction faces new marijuana trafficking charges

A 45-year-old man who received probation after being accused of possessing more than 30 pounds of marijuana in 2013 may have squandered his chance to avoid prison.

Daniel L. Forcucci pleaded guilty in early 2015 to a less serious felony charge and was sentenced to three years probation and court fines.

Forcucci, 45, of 2000 block of Limestone Lane, Carpentersville, is facing prison again after his arrest in late June on charges he possessed and planned to deliver at least 5,000 grams of marijuana, according to Kane County court records.

Messages left for Carpentersville Police officials seeking comment on how much marijuana was seized in the June 23 arrest were not returned.

Five kilograms of marijuana is equivalent to a little more than 11 pounds or 5,000 grams.

In the 2013 matter, authorities responded to a call at his home in West Dundee for a domestic dispute.

Forcucci was accused of throwing a doughnut in his girlfriend's face during an argument and punching an kicking her. Authorities noticed clues around the house, such as packaging material, that Forcucci might be dealing drugs and returned with a canine unit and search warrant.

Defense attorney Sam Amirante, who represented Forcucci in the 2013 case and the current case, could not immediately be reached for comment.

Forcucci is free on bond and next due in court July 21.

If convicted of the most severe charge, Forcucci faces between six and 30 years in prison and probation is not an option.

He also faces between four and 15 years in prison for violating his probation on the 2013 case.
