Sex offender gets 10 years in prison for fighting with arresting agents in Naperville

A 47-year-old Crest Hill man is off to prison for fighting with a U.S. marshal.

David Kapus, a convicted sex offender, pleaded guilty in DuPage County to disarming a police officer and was sentenced to 10 years in prison for the scuffle that occurred when the marshal attempted to arrest him on an outstanding warrant.

Kapus was placed on probation in 2015 for failing to register as a sex offender. Since that time however, he failed to report to the DuPage County Probation Department as ordered by the judge and an arrest warrant subsequently was issued for him.

At about 10:40 a.m. on March 23, detectives attempted to arrest Kapus after finding him hiding in a closet above a washer/drier unit in a Naperville home. As detectives struggled with Kapus, one of the detectives attempted to shoot him with a stun gun. During the struggle, Kapus disarmed the detective.

“Not only did (Kapus) flee the law in an attempt to avoid court-ordered sex offender registration, he also fought with officers as they attempted to apprehend him,” DuPage County State's Attorney Robert Berlin said in a written statement. “(Kapus') obvious disdain for the law has caught up with him and he will now spend a significant amount of time behind bars.”

Kapus will be required to serve at least half his sentence before being eligible for parole.
