Jail, probation in Aurora sexting case involving 15-year-old girl
An Aurora man has admitted to sexting a 15-year-old girl and was sentenced to two years of probation, according to Kane County court records.
Hugo F. Cruz, 51, of the 0-99 block of Margaret Lane, pleaded guilty to indecent solicitation/aggravated criminal sexual abuse, a felony, in exchange for less severe charges of grooming, distributing harmful material to a minor and sexual exploitation of a child being dismissed by prosecutors, records show.
Judge John Barsanti late last week accepted the guilty plea, which also requires Cruz to pay $2,070 in fines, not have any drugs or alcohol while on probation and to have no contact with the victim nor any other minors.
The sentence also included 116 days in jail and Cruz served 58 days at the Kane County jail while the case was pending. Under state law, Cruz was eligible for day-for-day credit for good behavior, so he was released after he pleaded guilty.
Prosecutors said Cruz sent the girl, who he knew, sexually explicit texts and at least one photo between Dec. 25, 2015 and Jan. 3.
If Cruz violates probation, he could be resentenced to up to five years in prison.
