Wisconsin college student due in court on ricin possession

GREEN BAY, Wis. - A University of Wisconsin-Oshkosh student accused of possessing the deadly toxin ricin is expected to make his first appearance in federal court.

Twenty-one-year-old Kyle Smith is due in court in Green Bay Monday where a judge should decide whether there's enough evidence to continue with the case against him.

Prosecutors claim Smith is a danger to the public due to his history of drug use and mental health issues.

But, defense attorney William Kerner argues that although Smith is being treated for depression and post-traumatic stress disorder, he is not a danger to the public because there's no proof he planned to hurt anyone with the ricin.

Smith has been suspended from the university pending the outcome of his case.
