Two men charged in Lombard beating

Two men face felony charges in the severe beating of a man near Lilacia Park in Lombard.

Justin Divito, 21, and Daniel Grimm, 19, appeared in DuPage County bond court Tuesday on aggravated battery charges.

The suspects were at 7-Eleven, 594 S. Main St. in Lombard, about 11 p.m. Saturday, prosecutors said, when they encountered the victim, who gave money to Grimm to buy a Taquito. He then left, walking toward nearby Lilacia Park, Assistant State's Attorney Anne Therieau said in bond court.

She said store surveillance footage had showed then men “getting along” but, at some point, Divito told Grimm the victim made a comment that Grimm “needed to get his (expletive) kicked.”

The suspects then followed and attacked the victim in the area of Park and Parkside Avenues, Therieau said.

“The victim says he curled up in a ball to avoid the blows,” Therieau said.

She said the victim was repeatedly kicked and punched. The beating ended when a 16-year-old girl at the nearby train station yelled out that she was calling 911.

Therieau said the victim received 18 staples to a head wound and suffered a concussion and several cuts and scrapes. Both defendants confessed to the beating in video interviews with police, she said.

Judge Elizabeth Sexton set bail at $60,000 for Divito, of the 0-100 block of North Main Street in Lombard, and $75,000 for Grimm, of the 100 block of North Westmoreland Avenue in Villa Park.

Grimm was charged additionally with battering a detective and resisting a peace officer. Prosecutors said he has previously served jail time for battery.

A third man was with the suspects but has not been charged, authorities said. Divito and Grimm, who both identified themselves as unemployed laborers, are due back in court later this month.
