Heroin supplier acquitted in Wisconsin overdose death

FOND DU LAC, Wis. — A jury in Fond du Lac County has acquitted a man of homicide charges for supplying the heroin that caused a drug user’s fatal overdose.

Jurors found 21-year-old Zachary Mallon not guilty of first-degree reckless homicide by delivering drugs and intimidating a witness. He was convicted of delivering heroin, a felony with a maximum prison sentence of about seven years.

District Attorney Dan Kaminsky tells The Reporter that jurors may have been questioned the chain of custody of the heroin, or were uncertain about the cause of Dustin Lamb’s death. The 22-year-old Fond du Lac man overdosed at his apartment in September 2010.
