Itasca company says ND lawsuit not proper

FARGO, N.D. -- An Itasca company accused of deceptive business practices says the case should be thrown out of federal court in North Dakota.

Fargo-based electronic transactions company Intercept Corp. filed a trademark infringement lawsuit against Accertify Inc. and its fraud-prevention service called Interceptas.

Officials with the Fargo company say they have been using the Intercept name since 1993, and they believe the Interceptas name could be confusing and deceptive.

Accertify says it doesn't do business in North Dakota and the case should be dismissed for lack of jurisdiction.
